Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
  • Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the entrepreneur.
  • Day: calendar day.
  • Long-term transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time.
  • Durable data carrier: any means that enables the consumer or entrepreneur to store information personally addressed to them in a way that makes future consultation and unchanged reproduction of the stored information possible.
  • Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period.
  • Model form: the withdrawal form provided by the entrepreneur that a consumer can complete when they wish to exercise their right of withdrawal.
  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
  • Distance contract: a contract concluded within the framework of a system organized by the entrepreneur for the distance sale of products and/or services, using exclusively one or more techniques for distance communication.
  • Means of distance communication: a means that can be used for concluding a contract without the consumer and the entrepreneur being in the same space at the same time.
  • General Terms and Conditions: these Terms and Conditions of the entrepreneur.

Article 3 – Applicability

  • These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
  • Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded where the general terms and conditions can be inspected, and that they will be sent free of charge to the consumer upon request.
  • If the distance contract is concluded electronically, the text of these general terms and conditions may, in deviation from the previous paragraph, be provided electronically in such a way that the consumer can easily store them on a durable data carrier.
  • In the event that specific product or service conditions apply in addition to these terms, the consumer may always rely on the provision that is most favorable to them in case of conflicting terms.
  • Situations not covered by these general terms and conditions, or ambiguities about their interpretation, shall be assessed “in the spirit” of these general terms and conditions.

Article 4 – The Offer

  • If an offer has a limited validity or is subject to conditions, this will be explicitly stated in the offer.
  • The offer is non-binding. The entrepreneur is entitled to change or adjust the offer.
  • The offer includes a complete and accurate description of the products and/or services offered. Images used are a true representation of the products and/or services. Obvious mistakes or errors in the offer are not binding.
  • Each offer contains information that makes it clear to the consumer what rights and obligations are attached to the acceptance of the offer.

Article 5 – The Agreement

  • The contract is concluded at the moment the consumer accepts the offer and meets the conditions set forth.
  • If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of acceptance electronically. As long as this confirmation has not been received, the consumer may dissolve the contract.
  • If the contract is concluded electronically, the entrepreneur shall take appropriate technical and organizational measures to secure electronic data transfer and ensure a safe web environment.
  • The entrepreneur may, within legal limits, obtain information about the consumer’s ability to fulfill payment obligations and about facts and factors relevant to responsibly concluding the distance contract. If the entrepreneur has legitimate grounds, he may refuse an order or attach special conditions to execution.
  • The entrepreneur shall send the following information to the consumer in writing or in a way that allows storage on a durable medium:
    • the business address of the entrepreneur where complaints can be submitted;
    • the conditions and method for exercising the right of withdrawal, or a clear statement if withdrawal is excluded;
    • information about warranties and after-sales service;
    • the conditions for terminating the contract if it has a duration of more than one year or is of indefinite duration.
  • Every contract is concluded under the suspensive condition of sufficient availability of the products ordered.

Article 6 – Right of Withdrawal

For products 
  • The consumer may dissolve a purchase contract for a product without giving reasons within 14 days. The withdrawal period starts on the day after the consumer, or a third party designated by the consumer, has received the product.
  • During the withdrawal period, the consumer shall handle the product and packaging with care. They shall only unpack or use the product to the extent necessary to determine whether they wish to keep it. If exercising the right of withdrawal, the product shall be returned with all delivered accessories and, if reasonably possible, in the original condition and packaging.
  • The consumer must notify the entrepreneur of the withdrawal within 14 days after receiving the product. After notification, the consumer must return the product within 14 days.
For services
  • In the case of services, the consumer may dissolve the contract within at least 14 days after conclusion, without giving reasons.
  • To exercise the right of withdrawal, the consumer must follow the instructions provided by the entrepreneur.

Article 7 – Costs in Case of Withdrawal

  • If the consumer exercises the right of withdrawal, the cost of return shipping shall be borne by the consumer.
  • If the consumer has already paid, the entrepreneur shall refund the amount as soon as possible, but no later than 14 days after withdrawal, provided the returned product has been received or proof of shipment is supplied.
  • If the product is damaged due to improper handling by the consumer, the consumer is liable for any decrease in value.

Article 8 – Exclusion of the Right of Withdrawal

  • The entrepreneur may exclude the consumer’s right of withdrawal for certain products or services, provided this is clearly stated in the offer and before the contract is concluded.
  • Exclusion is only possible for products:
    • made to the consumer’s specifications;
    • clearly personal in nature;
    • which by their nature cannot be returned;
    • which can spoil or age quickly;
    • whose price depends on financial market fluctuations;
    • newspapers or magazines;
    • audio/video recordings or software whose seal has been broken;
    • hygienic products where the seal has been broken.
  • Exclusion is only possible for services relating to:
    • accommodation, transport, catering, or leisure activities on a specific date;
    • services commenced with explicit consumer consent before the withdrawal period ended;
    • betting and lotteries.

Article 9 – The Price

  • During the validity period stated in the offer, prices shall not be increased, except due to changes in VAT rates.
  • Products or services subject to financial market fluctuations beyond the entrepreneur’s control may have variable prices. This will be stated in the offer.
  • Price increases within 3 months after conclusion of the contract are only permitted if due to legislation.
  • Prices stated include VAT.

Article 10 – Conformity and Warranty

  • The entrepreneur guarantees that the products and/or services comply with the contract, the specifications stated, and legal requirements in force at the time of contract conclusion.
  • Any warranty provided by the entrepreneur, manufacturer, or importer does not affect the legal rights of the consumer.
  • Warranty does not apply if:
    • the consumer has repaired or modified the product themselves;
    • the product has been exposed to abnormal conditions or handled negligently;
    • defects are due to regulations imposed by authorities.

Article 11 – Delivery and Execution

  • The entrepreneur shall exercise the utmost care when receiving and executing product orders.
  • The delivery address is the one provided by the consumer.
  • Accepted orders shall be executed promptly, no later than 30 days, unless otherwise agreed. If delayed, the consumer has the right to cancel without cost.
  • The risk of damage and/or loss rests with the entrepreneur until delivery to the consumer.

Article 12 – Long-Term Transactions: Duration, Termination and Renewal

  • Termination: The consumer may terminate indefinite contracts at any time with a notice period of no more than one month. Fixed-term contracts can be terminated at the end of the fixed period, with the same notice.
  • Renewal: Fixed-term contracts cannot be automatically renewed or extended beyond the agreed period, except for newspapers/magazines under specific conditions.
  • Duration: If a contract exceeds one year, the consumer may terminate after one year with one month’s notice.

Article 13 – Payment

  • Unless otherwise agreed, amounts due must be paid within 7 working days after the start of the withdrawal period.
  • The consumer has a duty to promptly report inaccuracies in payment data.
  • In case of non-payment, the entrepreneur has the right to charge reasonable costs made known in advance.

Article 14 – Complaints Procedure

  • The entrepreneur has a well-publicized complaints procedure and will handle complaints accordingly.
  • Complaints must be submitted within 2 months after defects are discovered.
  • Complaints will be answered within 14 days. If more time is required, the consumer will be notified with an expected timeline.
  • If the complaint cannot be resolved mutually, it becomes a dispute subject to Article 15.

Article 15 – Disputes

  • Dutch law exclusively applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply.
  • The Vienna Sales Convention does not apply.

Article 16 – Additional or Deviating Provisions

Additional provisions or provisions deviating from these terms may not be to the detriment of the consumer and must be recorded in writing or stored in a durable manner accessible to the consumer.

We disclaim all responsibility for misuse, mishandling, or unlawful application of our products.  

Storage and Stability
  • Store products in a cool, dry place, away from direct sunlight.
  • Keep out of reach of unauthorized personnel and children.
  • Follow all storage guidelines provided with the product.
Governing Law

These disclaimers and conditions are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
